Making the decision to sue someone is not something that should be undertaken lightly. We’ve all heard jokes about how litigious American society is, and while it’s true that a lot of lawsuits get filed, 很多都是合法的. Innocent people who get hurt because someone else behaved recklessly deserve to be compensated for their suffering. Parties who uphold their end of a contract should be able to enforce its terms. Couples who conclude that they are better off apart must have a way to dissolve their marriage.
Although generalities can be discussed, it is important to note that every lawsuit is based on a unique set of circumstances, and the steps that lead to resolve one situation may unfold differently in another. Expect that while a trial usually only takes a few days, getting to court in the first place can take months or even years. The lengthy wait for a ruling is one of the reasons that many cases are settled.
In deciding to sue, the basic questions to answer are:
- Who to sue (identification of all responsible parties)?

After these preliminary issues are dealt with, the court establishes deadlines and sets the matter for trial. If at any time the parties are able to compromise, they can enter into an agreement that settles the dispute and simply notify the court that the case has been resolved and should be dismissed.
